    These Terms of Service govern your use of www.loanamerica.com and the tools, forms, calculators, and content available on it. LoanAmerica® is a name for American Originations LLC. In these terms, "we," "us," and "our" refer to LoanAmerica®, and "you" refers to the person using the site.

    1. Acceptance of these terms

    By accessing or using this site you agree to these terms and to our Privacy Policy. If you do not agree, do not use the site. If you use the site on behalf of a school or other organization, you confirm that you have authority to bind that organization to these terms.

    2. Eligibility

    The site is intended for users who are at least 18 years old and located in the United States. Loan products, where offered, are available only to eligible borrowers at accredited U.S. institutions, subject to credit review, underwriting approval, school certification, and applicable state law.

    3. What this site is and is not

    The site provides information about education financing, tools to estimate costs and payments, and forms to express interest or begin an application. Nothing on the site is an offer of credit, a commitment to lend, a preapproval, or a guarantee of any rate, term, or amount. Any offer of credit will be made in writing with the disclosures required by the Truth in Lending Act and other applicable law.

    This content does not constitute legal, financial, or tax advice. For information about existing federal student loans, contact your servicer or visit studentaid.gov.

    Nothing on this site is an offer to sell or a solicitation to buy any security.

    4. Inquiries and loan applications

    When you submit an inquiry or application you agree that the information you provide is accurate and complete, and that you will update it if it changes. Submitting information does not create a lending relationship.

    All loan applications are subject to credit review and underwriting approval. We may verify the information you provide, request supporting documents, obtain consumer reports where you have authorized us to do so, and decline any request consistent with applicable law. Providing false or misleading information may result in denial, rescission, or referral to the appropriate authorities.

    School partners who submit institutional information through our partner forms agree to submit only information they are permitted to share and to keep any access credentials confidential.

    5. Calculators and estimates

    Our calculators produce illustrative estimates based on the values you enter and on general assumptions about federal program rules. They are educational tools only. Results are not quotes, are not personalized advice, and may differ from actual costs, aid awards, rates, payments, or eligibility. Verify federal aid figures with your financial aid office or at studentaid.gov before making a borrowing decision.

    6. Accounts, access codes, and partner portals

    Some areas of the site, including partner intake pages and administrative tools, require an access code or account. You are responsible for keeping credentials confidential and for activity that occurs under them. Access codes and secure links are issued for a specific recipient and may expire. Do not share them. Tell us right away at [email protected] if you believe a credential has been compromised.

    We may suspend or revoke access at any time, including when a link expires or when we suspect misuse.

    7. Acceptable use

    You agree not to:

    • Use the site for any unlawful or fraudulent purpose.
    • Submit information about another person without their authorization.
    • Attempt to access accounts, data, or systems you are not authorized to access, or probe or test our security.
    • Scrape, harvest, or bulk download content, or use automated tools to submit forms.
    • Introduce malware, interfere with the site's operation, or place unreasonable load on our infrastructure.
    • Copy, republish, or resell site content or reverse engineer any part of the site.
    • Misrepresent your identity, your school affiliation, or your authority to act for an organization.

    8. Intellectual property

    The site and its content, including text, graphics, logos, layouts, calculators, and software, are owned by LoanAmerica® or its licensors and are protected by intellectual property law. LoanAmerica® is a registered trademark. You may view and print content for your personal, non commercial use in evaluating education financing. All other rights are reserved.

    9. Your submissions

    You keep ownership of the information and documents you submit. You grant us a non exclusive license to use, store, and process that material to respond to your request, evaluate an application, operate and improve the site, and meet legal obligations, as described in the Privacy Policy. If you send us feedback or suggestions, we may use them without obligation to you.

    10. Third party links and services

    The site links to third party resources such as studentaid.gov, scheduling tools, and school websites, and relies on third party providers for hosting, analytics, and communications. We do not control those services and are not responsible for their content, availability, or practices. Your use of a third party service is governed by that provider's terms.

    11. Electronic communications and signatures

    By using the site you consent to receive communications from us electronically, including by email and, where you provide a phone number and consent, by text message. Message and data rates may apply, and you can opt out of marketing messages at any time. We may still send messages about an active inquiry, application, or loan.

    You agree that electronic signatures, consents, and records satisfy any legal requirement that such items be in writing, consistent with the federal E SIGN Act and comparable state law. You may withdraw consent to electronic records by contacting us, which may prevent us from continuing an online application.

    12. Disclaimers

    The site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non infringement. We do not warrant that the site will be uninterrupted, secure, or error free, or that content, rates, or program information is complete or current. Federal aid rules change, and figures on this site may not reflect the most recent guidance.

    13. Limitation of liability

    To the fullest extent permitted by law, LoanAmerica®, its affiliates, and their officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost savings, lost data, or loss of educational or business opportunity, arising out of or relating to your use of the site. Our total liability for any claim relating to the site will not exceed one hundred dollars.

    Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these terms limits rights you have under consumer financial protection laws or under the terms of any loan agreement you sign.

    14. Indemnification

    You agree to indemnify and hold harmless LoanAmerica® and its affiliates from claims, losses, liabilities, and reasonable legal fees arising from your misuse of the site, your violation of these terms, or your infringement of the rights of another person or organization.

    15. Governing law and disputes

    These terms are governed by the laws of the State of Nevada, without regard to conflict of law rules. Except where prohibited, you and LoanAmerica® agree that any dispute relating to the site will be brought in the state or federal courts located in Clark County, Nevada, and both parties consent to that jurisdiction.

    If a loan agreement you sign contains its own dispute resolution provisions, those provisions control for matters arising under that agreement. Before filing a claim, please contact us so we can try to resolve the issue directly. Details on raising a concern are on our compliance page.

    16. Changes to the site and these terms

    We may modify, suspend, or discontinue any part of the site at any time. We may also update these terms as our products or legal obligations change. The date at the top of this page shows the last revision. Continued use of the site after an update means you accept the revised terms. If any provision is found unenforceable, the rest remains in effect.
